Government Investigations and Litigation Attorneys

Texas agency investigations 2When a Texas State Agency comes knocking with questions, you should call Cobb & Counsel before you answer the door.  In his three years of public service with the Texas Attorney General’s Office, Cobb was first appointed to be a Special Assistant and Senior Counsel to Texas Attorney General Greg Abbott, and was later appointed to be the Deputy Attorney General for Civil Litigation.  During this time, Cobb represented, counseled, and advised most Texas State Agencies, and many state officials. Cobb is therefore intimately familiar with the operation and interaction of Texas government at large.

Fortune 500 corporations, small businesses, and licensed professionals alike are often the subject of investigations conducted by the vast web of Texas regulatory agencies. Frequently, these investigations start with a Notice of Violation, and result in a Notice of Hearing, which initiates an enforcement action.  Cobb & Counsel has represented companies across the spectrum of Texas State Agency regulatory oversight, including responding to a Notice of Detention issued by the Department of State and Health Services, preventing a Notice of Violation from the Texas State Securities Board, responding to a Hearing Notice from the Texas Department of Insurance, and appealing the denial of a license application with the Texas Department of Public Safety.

Litigation and Enforcement Action Avoidance Counseling in Austin, TX

As trial lawyers, we love to litigate. Our clients, not so much. For most, litigation avoidance is a priority. So the first thing we do after we are engaged is to pick up the phone. We talk to the attorney that issued the Civil Investigative Demand (“CID”), Subpoena, or Notice of Hearing/Violation. We begin a dialogue based upon common experience and trust, and start to manage the process. We don’t claim to have a magic wand we can wave that makes government attorneys go away, but we do have experience working with the Texas Attorney General’s Office and many Texas State Agencies in an effort to resolve disputes prior to their becoming public, prior to any adverse regulatory findings, and prior to any litigation. Contact Cobb & Counsel attorneys before the government investigation morphs into an enforcement action.
